Sarah M(artha) JAYNE was born on 22 Jul 1812 in TN. She died on 6 Nov 1853 in Shelby Co, IL. She was buried in Bateman Cem, Cold Spring Twp, Shelby Co, IL. She married Nelson, Sr POWELL on 20 Feb 1832 in Vermilion Co, IL, by Rev Henry Hannas, Baptist Min.

8/22/1834 She bought another 40 acres, same price.

1850 Shelby Co, IL. She was a widow and head of the household with Gillan Hannas, 65, living with her.

Her mother verified Sarah's age was 19 at the time of her wedding.

There is a death date discrepancy between her gravestone with 10/15/1852 and court records with 11/6/1853.

Sarah's will was filed 11/1854. John Warren was administrator and heirs mentioned were: Gilly Jane, Moses, and minor children, Elizabeth, Aaron, and Sarah, who requested William Mears remain as their guardian.

Securities were posted by Jesse A. Spurgeon, Gilly's husband.

Claims against the estate were paid to Gilly Jane and Moses.

Daughter, Louisa, was not mentioned even though she did not die until 1855.

They had the following children:

F i Gilley Jane POWELL was born on 28 Jan 1833. She died on 17 Oct 1887.
F ii Louisa POWELL was born on 8 Feb 1835. She died on 7 Oct 1855.

F vi Sarah POWELL was born in 1844. She died before 1878.

Simon POWELL [Parents] was born in 1770 in SC. He died on 27 Mar 1814 in Estill Co, KY. He married Rhoda Jane "Jenny" JOHNSON on 6 Oct 1795 in Harrison Co, KY, by Rev Benjamin Coleman.

According to the "History and Genealogies of Powells in America," Simon and Jane had 2 other daughters besides Isabel, who lived in Cambridge City, IN, but did not name them.

Residences & events:

1770 South Carolina. Simon's parents, as well as at least one of his aunts and a first cousin, moved to SC where he was born.

1780 Virginia

1789 Fayette Co, KY. Simon being only 19 years old, probably migrated with his parents. His father was listed in the tax rolls there in 1789, 1791, & 1792.

1793 Clark Co, KY. His father moved and Simon went with the family. He was listed for the first time in the tax list in 1794, then again in 1797, 1799, & 1800.

1794 Simon and brother, Oner, were surety for the weddings of their sisters, Betsy on 5/19/1794 and Frances on 7/28/1794.

1800 Simon and brothers, Ambrose and Thomas, Jr, along with their father, were listed on the county tax roll.

1803-1806 Simon was again listed on the tax rolls for these years but was absent 1807-1809.

1810 Estill Co, KY, where he was listed in the census with a family consisting of 3 males under 10, 2 males 10-16, 1 male 26-45 (himself), 1 female under 10, 1 female 26-45 (Jenny).

1813 At tax time the Powells in the county besides Simon were Thomas and James, probably his brothers.

3/11/1813 - 9/11/1813 He served as a Private with Capt Dudley Farris' Company of Infantry of KY Detached Militia commanded by Lt Col Wm Dudley. He was most likely among the soldiers captured and brutalized by the Indians in "Dudley's Defeat" on the Vermillion River because of the 800 men who followed Dudley, only 170 escaped to Fort Meigs, the rest being either killed or made prisoners. This might explain why he was healthy enough to answer the call to enlist but died a few months later.

2/19/1814 Wayne Co, IN. Simon received NW 1/4-S 26, government land, possibly as payment for fighting in the War of 1812. He returned to KY but died before he could bring the family back to Indiana. Jenny took the family to IN anyway where they cleared the land and began farming. Their cabin stood on the east bank of the river, south of East Cambridge.

There was a country wide financial crash in 1837 which completely demoralized values. Although we do not know the financial condition of Simon's children before or after the crash, they, like most settlers, built their own houses, raised their own food, and met their
own needs.

Some relatives say his death was 2/14/1814 but according to one allegedly with the family Bible, it was as posted. And since he received the Indiana land on 2/19/1814, the earlier date must to be be incorrect.

Simon was probably injured while serving in the War of 1812, the effects of which may have contributed to his death. Some of the soldiers of his unit were captured and brutalized by Indians before escaping. Simon could have been one of them.

Rhoda Jane "Jenny" JOHNSON [Parents] was born on 13 May 1772 in Anderson Co, SC. She died on 9 May 1853 in Newark, OH. She was buried in Cedar Hill Cem, Newark, OH. She married Simon POWELL on 6 Oct 1795 in Harrison Co, KY, by Rev Benjamin Coleman.

Residences & events after Simon's death:

1814 Estill Co, KY. Jenny was listed as head of the house on the tax rolls along with Ambrose and Thomas Powell, Simon's brothers.

1820 Wayne Co, IN. Jenny was again head of the house and over 45. Her family included: 4 males 10-15, 1 male 16-18, one male 19-25, 1 female under 10. Living in the same county was a James Powell who was in the same age bracket as Jane, possibly Simon's brother. Also listed were a William and Thomas Powell of the younger generation.

Licking Co, OH. Following her marriage to John Van Buskirk, she moved to OH where several of his relatives lived. Some of her children moved with them but most eventually returned to IN and on to the west.

LDS files record her birth date as 5/7/1766. However, the 1772 date
agrees with her age at death.

12/23/1882 Jesse applied for a pension based on the Civil War service of son, James:

"I am now 65 years of age. I am the father of James F.M Spurgin who was a member of 1K 1A Regt Ill Infy Vols. who died in the service of the United States. He was in the service about 2 months when he died in April 1865 to the best of my recollection. I did not know he had volunteered until after he was dead.
I did not want him to go into the service, as I thought he was too young to endure the fatigues and exposures incident to a soldier's life. I was then living in this county. He went to Illinois and enlisted. I went back to Illinois some time after his death and was advised to apply for a pension on account of his loss and my eyes.
I did not do so, as I thought I could suffle (suffer ?) on as I had been doing. My eyes troubled me very much, but all the doctoring I could do, done me no permanent good.
Sometimes I could see well enough to work and then my eyes would get worse and I could not work. I disliked the idea of being a pensioner and postponed the matter of applying from time to time, often thinking I ought to do so.
The testimony of my brother Aaron Spurgin cand his son Samuel is as good and perhaps the best I can give. They both knew my circumstances while living in Illinois and also in Missouri. Thye moved to Missouri a few months before I did.
I have furnished the testimony of Jess Lambeth, one of the best men of the county, in regard to my condition for many years past. I did not hear his affidavit read, and do not know its contents, but he has help for years. John Miller another good man has also given testimony in my case, but what the contents of his affidavit is I know not. With this, I send the testimony of Thomas H. Bryan and wife.
I have forward testimony that Dr Leander Rainy is dead. He had prescribed for me in his life, but his prescriptions were only of temporary benefit. I have also forwarded the testimony of Dr T.J. Fitts, he also prescribed for me, but without permanent relief. Had I been able to live without work, and have gone to some physician who made diseases of the eye a special study, I might have been cured.
It is impossible for me to say what my income or earnings were worth per month or by the year, as I could not work steadily, nor can I, or any else give the earnings of my son, as no account was kept of his work. His wages were paid to me and were consumed by myself and family.
I have sent testimony of my sons death and also that of his mother, also my marriage to her. For years I have quit going to any doctor for eye salves or washes, as not one of them done me any good. I have tried propular remedies, such as washes and poultices of various kinds, but nothing benefits them permanently. Quietness and freedom from dust is has a beneficial effect but I cannot keep quiet--I must work all I can."

The affidavit of Dr Thomas J Fritts of Lakewood, IL, said he "prescribed for him, he being at that time afflicted with chronic sore eyes. I also prescribed for his wife, who was at time insane. I did not prescribed for the crippled and idiotic child the daughter of said Jesse K Spurgin."

Mr John Miller testified: "I know Jesse K Spurgin. I have been acquainted with him ever since he came to this section of the country. Part of the time he lived about one fourth of a mile from me. In 1863, 1864, 1865 and 1866. In 1866 he moved away about 7 miles off.
He was then a very poor man and is still a poor man. For the last six years, more or less, he has lived in the same school district with me. He now lives about two miles from me. I know that Jesse K Spurgin is an honest, sober and industrious man willing to work when ever he is able to do so. Ever since I knew him he has been afflicted with sore eyes.
He moved from place to place several times in the past 20 years and I believe he went to Illinois on two occasions (missing line - to visit his son and) daughter. I cannot tell anything about what assistance the boy rendered his father, but suppose that he done as other poor mens' boys have to do work all they can.
I would not be willing to give Jesse K Spurgin fifty dollars a year for all the work he could do, and be impelled to board and clothe him--to clothing to be such as laboring men wear. He has worked for me.
I have no interest in the claim of Jesse K Spurgin for pension nor am I concerned in its prosecution.
Jesse K Spurgin has no source of income except that of manual labor and such help as he receive from his son Aaron. He owns no real estate that I know anything about, but rents a little land every year."

He & 1st wife lived next door to Gilly & her parents in 1850 census.

4/26/1869 She was declared insane and admitted to the State Hospital per the following:

"In the matter of Gilly Jane Spurgin, alleged to be Insane.

Whereas Jesse K. Spurgin of the County aforesaid has duly filed in the County Court of said County a statement that Gilly Jane Spurgin of the County and State aforesaid is Insane and that said Jesse K. Spurgin believes that said Gilly Jane Spurgin for her benefit and for the safety of the community, ought to be committed to the Illinois State Hospital for the Insane and the facts of her case can be proven by Dr. E. Penwell, a regular physician and by William Mears both of whom reside in said County.

And the above order of the Court having been complied with, comes now the Sheriff into Court with the body of said Gilly Jane Spurgin alleged to be Insane and notice of this proceeding having been duly served upon the said Gilly Jane Spurgin as required by law.
Whereupon comes a jury to wit: W.G. Wilson, M.D.; James Goodwin; R.B. Miller; G.E. Guion; J.T. Nelson and William Myers, who being duly elected tried and sworn according to law, and having heard the evidence for verdict say:
' We the undersigned Jury in the case of Gilly Janes Spurgin alleged to be Insane having heard the evidence in the case are satisfied that said Gilly Jane Spurgin is Insane, and is fit person to be sent to the Illinois State Hospital for the Insane; that she is a resident of the State of Illinois and County of Shelby, that her age is 35 years, that her disease is of about 15 months duration; that the cause is unknown - but follows a fever attended with sore eyes, that the disease is with her not hereditary; that she is not subject to Epilepsy, and that she is free from vermin; or any infectious disease, and that she is a pauper.
It is therefore ordered by the Court that said Gilly Janes Spurgin be conveyed by the sheriff to the Illinois State Hospital for the Insane at Jacksonville to be treated for her said disease, &c.' "
